Emergency Ordinance Officially Revoked - 10km Travel Radius Still Enforced?

Berita Kereta

The official revocation of the emergency ordinance has now passed, so what does this mean for SOPs and emergency laws? Is the 10km travel radius still enforced?

According to the news portal Free Malaysia Today, lawyers have advised that we should continue to obey emergency ordinances on movement control despite the state of emergency ending on August 1.

"The Federal Constitution states that emergency ordinances remain valid for six months after a state of emergency ceases. In addition, the Prevention and Control of Infectious Diseases Act remains in force and rules and SOPs, including restrictions on travel and movement, set by the health ministry and the health director-general, still apply".

What this means is that the PDRM and the relevant enforcement agencies can still slap you with a maximum fine of RM10k for individuals and RM50k for companies. This fine was put into action on January 11, 2021, after Malaysia was placed under a nationwide state of emergency, which then resulted in new laws under the emergency ordinances.

Even with or without the emergency ordinance, the Prevention and Control of Infectious Diseases Act still needs to be followed, and rules as well as SOPs, including:

  • 10km travel radius from your home
  • no interstate travel
  • no interdistrict travel

These stricter SOPs were put in place on June 1, 2021 after a nationwide lockdown was announced due to the rise of COVID-19 cases in the country. It's been more than 500 days since Malaysia's Movement Control Order (MCO) lockdown began. MCO officially started on March 18, 2020.
